CatCare - Pet Health Terms of Service

Welcome to the CatCare - Pet Health mobile application and related services ("the Service"). The Service is provided by yystudio ("we," "our," or "us") and is designed to offer features such as pet health tracking, AI breed identification, photo storage, subscription management, and multi-user collaboration.

Please read these Terms of Service carefully. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

You confirm that you are at least 13 years of age (despite the app's age rating of 4+ as per the Children's Privacy provisions in the Privacy Policy, we do not collect personal data from children under 13), or have obtained the consent of your parent or legal guardian. You agree that these Terms constitute a legally binding agreement between you and yystudio.

2. Service and Usage License

2.1 Service Content

The Service provides the following core functions:

• Pet health data tracking (e.g., name, breed, age, weight, medical and vaccination records).
• AI-driven cat breed identification.
• Storage of user-generated content (pet photos, notes, files).
• In-app subscription and purchase management.
• Multi-user collaboration and sharing of pet profiles.

2.2 Account Security

You are solely responsible for maintaining the confidentiality of your account information, including your Apple, Google, or email login credentials. You agree to notify us immediately of any unauthorized use of your account.

3. User Conduct and Restrictions

You agree to comply with all applicable laws and regulations when using the Service and agree not to engage in the following activities:

• Posting or uploading any content that is unlawful, harmful, threatening, harassing, defamatory, obscene, or infringes on the intellectual property rights of others.
• Transmitting any material that contains viruses, Trojan horses, or other harmful or destructive programs.
• Attempting to gain unauthorized access to the Service, servers, or networks connected to the Service.
• Using the Service for any commercial purpose (unless through an explicit paid cooperation agreement).
• Uploading or submitting photos or data that contain a third party's personal information, unless you have obtained the express authorization of that third party.

4. User-Generated Content

4.1 Content Ownership

You retain all ownership rights to all data, information, photos, notes, and files ("User Content") that you upload, store, or transmit through the Service.

4.2 Content License

In order to operate and provide the Service (including enabling AI breed identification, data backup, and multi-user collaboration), you grant yystudio a worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, host, store, modify, create derivative works (such as processing photos for AI identification), publicly display, publicly perform, and distribute your User Content. This license terminates upon your deletion of your account or content.

4.3 AI Processing

You understand that your uploaded pet photos may be used for AI processing to identify breeds and enhance health insights. Your images will not be used for advertising analysis.

5. Subscriptions and Payments

5.1 Purchases and Billing

The Service offers auto-renewable subscriptions. Payment will be charged to your iTunes Account at confirmation of purchase.

5.2 Auto-Renewal

Your subscription automatically renews unless auto-renew is turned off at least 24-hours before the end of the current billing period. Your account will be charged for renewal within 24-hours prior to the end of the current period, and the cost of the renewal will be identified.

5.3 Managing Subscriptions

You can manage or turn off auto-renewal in your Apple ID Account Settings any time after purchase. No cancellation of the current subscription is allowed during the active subscription period.

5.4 Refunds and Free Trials

All refund requests are handled by Apple. Any unused portion of a free trial period, if offered, will be forfeited when the user purchases a subscription to that publication, where applicable.

5.5 EULA

6. Multi-User Collaboration

The Service allows you to invite family members, veterinarians, or external collaborators to access your pet profiles.

• Responsibility: As the account owner, you are fully responsible for the actions of anyone you grant access to.
• Control: You can control and revoke access to the pet profile at any time.

7. Third-Party Services

The Service uses the following third-party services: Firebase (Auth, Analytics, Crashlytics, Storage), Apple Sign-In, Google Sign-In, and RevenueCat. You understand and agree that these service providers process data according to their respective privacy policies and terms of service. We are not responsible for the content, features, or conduct of any third-party services.

8. Intellectual Property

The CatCare - Pet Health application, software, design, trademarks, logos, and all proprietary content (excluding User Content) are the property of yystudio or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or exploit any part of the Service.

9. Disclaimer

The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

• Not Medical Advice: The pet health tracking and insights features provided by the Service are not a substitute for professional veterinary diagnosis or treatment. You should always consult a qualified veterinarian for medical advice.

10. Limitation of Liability

To the maximum extent permitted by applicable law, yystudio and its affiliates shall not be liable for any indirect, incidental, special, punitive, or consequential damages (including loss of profits or loss of data) arising from your use or inability to use the Service, even if we have been advised of the possibility of such damages.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time for any reason (including, but not limited to, a breach of these Terms) without prior notice.

12. Data Retention and Deletion

You can delete your account and all associated data at any time through "App Settings" or by emailing yy@yynomad.com. Deleted data will be permanently removed within a reasonable timeframe.

13. Updates to Terms

We may update these Terms of Service at any time. Any changes will be communicated to you within the app or via email. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
